These terms cover using FICO — the space itself, the members' area at app.ficoworking.com, and the FICO mobile apps. They are one service, so there is one set of terms.

Who you are contracting with

FICO Coworking is operated by Christian Campoli, NIE Y8479494Y, at Calle Prudencio Morales 73, 35009 Las Palmas de Gran Canaria, Spain — info@ficoworking.com, +34660443986. "We" and "us" below mean that person; "you" means the member.

Your account

You need an account to book anything. You give us your name and an email address, and choose a password. One account per person, one email address per account. Keep the password to yourself — anything done from your account is treated as done by you.

Membership is for adults; we don't create accounts for under-18s.

You can close your account whenever you like — see Delete your data. Closing it does not refund unused credits, except where you are withdrawing from an online purchase within 14 days — see If you change your mind.

Credits, and what they buy

FICO runs on credits rather than open-ended access. You buy or are granted credits of a particular kind, and a credit buys one booking. The kind of credit decides when you may be in the building — that is the part worth reading twice, because it is what the door obeys:

  • Regular Day — Monday to Friday, 08:30 to 18:00. One full day at a desk.
  • Half Day — Monday to Friday, a morning or an afternoon. Half days are a weekday product; there is no flexible half day.
  • FICO Flex — Monday to Friday, 07:00 to 22:00. The same days as a Regular Day, with the door open earlier and later.
  • Phone booth — booked in quarter-hour slots, and included with a desk day rather than sold separately. You need a desk booking on the same day to book the booth, and the slot has to fall inside the desk booking you hold: a morning at a desk does not buy an afternoon in the booth.

Credits are not money. They cannot be exchanged for cash, transferred to another member, or used to pay for anything other than what they buy here.

A credit may carry an expiry date, which we tell you at the time you buy it — a 10-day pass, for example, is valid for 90 days. When credits expire they stop being usable and are not replaced. Where you hold several credits at once, bookings spend the soonest-to-expire first, so nothing is wasted while something else sits unused.

You cannot combine two credits into one booking or split one across two. Two half days are two bookings, a morning and an afternoon — not a full day.

Booking, and cancelling

Book through the members' area. A booking is confirmed straight away if there is room, and it costs the credit at the moment you make it. Desks can be booked up to 30 days ahead, the phone booth up to 7.

Cancelling in time refunds the credit in full. "In time" means at least 24 hours before the start for a desk, and any time before the start for the phone booth — a booth slot you release two minutes early is a slot someone else can take. Cancel later than that and the booking is cancelled but the credit is spent.

Weekly and monthly memberships are the exception: those days are held for you whether or not you come, so cancelling one frees the desk but does not return the credit. That is what reserving a desk means.

If we cancel your booking — for a closure, maintenance, or anything else at our end — you get the credit back in full, whatever kind it is and however close to the start it happens.

Opening, and closing

We close on public holidays and occasionally for maintenance or a private booking. We announce closures on the website and in the app as far ahead as we can, and refund the credits for any booking a closure catches. Beyond that refund we are not liable for a closed day — if you need a guarantee of access on a specific date, tell us and we'll confirm it in writing.

Paying

Card payments are handled by Stripe. You pay once, up front, for what you are buying — we take no recurring card payments and store no card of yours, so nothing is ever charged to you automatically. Stripe emails your receipt.

Weekly and monthly memberships, and day passes bought at the desk, are arranged and paid with us directly. Your credits are granted when the payment is made; there is no automatic renewal, so a membership continues only when you and we agree the next one.

Prices shown on this site are in euros and are what you pay — IGIC included.

If you need an invoice (factura) — because you are deducting the cost as a freelancer or a company — tell us when you book. IGIC is then added to the listed price and itemised separately, as invoicing rules require. It is the same tax either way; on an invoice it has to be shown as its own line rather than folded into the total, so the amount you pay is higher than the headline figure. Ask before you pay: we cannot re-issue a tax-inclusive sale as an invoice after the fact.

We can change our prices, but never for something you have already bought.

If you change your mind

This depends on how you bought. Buying online — through the app, or by a link or message we sent you — is a distance sale, and you have 14 days to withdraw without giving a reason. Buying in person here at FICO is not a distance sale and carries no such right, though we will always talk to you. What matters is where the purchase was agreed, not where it was paid: if you chose it in the app and settled up at the desk, it counts as online.

For credits bought online, we refund what you paid less the value of the credits you have already used, charged at our standard day rate rather than the pack rate — a pack is priced for someone taking all of it, so if you leave early you pay the ordinary price for the days you took. A credit you have already used to make a booking is not itself refundable: by booking with it you ask us to provide the service straight away and accept that the right to withdraw is lost for that credit. The deduction never exceeds what you paid, so a heavily used pack refunds nothing — but you will never owe us anything on withdrawing.

Weekly and monthly memberships work differently, because buying one books your days immediately rather than giving you credits to spend. If you withdraw within 14 days of buying one online, we refund the days you have not yet had, and keep the value of the days already passed — charged at our standard day rate rather than the membership rate, since the membership price assumes the full term. Once the week or month has run its course it is fully provided, and the withdrawal right no longer applies.

A day or half day bought for a specific date is booked the moment you pay. A booked day can be cancelled, but cancelling returns nothing — you bought that day, not a credit to move around. By paying you ask us to provide the service on that date and accept that the right to withdraw does not cover a day already provided; before it, the 14 days above apply as they do to a membership.

To withdraw, email info@ficoworking.com within the 14 days and tell us you are withdrawing — a sentence is enough. You may use the model withdrawal form below, but you do not have to. We refund by the same method you paid, within 14 days of being told.

Using the space

Use FICO for work, treat the place and the people in it decently, and don't do anything unlawful from our address or our wifi. Don't let anyone else in on your access — the door opens for you, not for whoever is with you.

Usually we'll talk to you first. If something needs to stop, we'll say so in writing and give you a chance to put it right. If it doesn't stop, or if what happened is serious enough that carrying on isn't sensible — violence, threats, theft, or anything unlawful — we can end the membership straight away. Either way we'll tell you why in writing.

If we end a membership for that reason, we refund the credits you have not used, less any cost you have caused us — damage, or a cleaning or repair bill — which we will itemise.

Your belongings are your own responsibility. We are not insurers of what you bring in, and we don't recommend leaving valuables here overnight.

The other way round: if you damage something of ours through carelessness or deliberate misuse, we'll ask you to cover the cost of repairing or replacing it, at what the item was worth rather than what a new one costs. Fair wear and tear is ours to absorb — things break from being used, and that is our cost of running the place, not yours.

The app

We give you a personal, non-transferable right to use the FICO app for as long as you are a member. Don't copy it, take it apart, or try to work around the parts that decide what you may book — the same rules apply in the app as everywhere else, and the server is what enforces them.

The apps are distributed through Apple's App Store and Google Play. Those stores' own terms apply to the download; this contract is between you and us, and neither Apple nor Google is party to it or responsible for the service.

We may change or update the app and the members' area. We aim to keep them available but do not promise uninterrupted service — if a booking can't be made because something of ours is down, tell us and we'll make it right.

Your data

How we handle your personal data is set out in our privacy policy, which forms part of these terms.

Our responsibility to you

We are responsible for providing the service described here with reasonable care and skill. We are not responsible for indirect losses — lost profits, lost business, lost data — and our liability for anything arising out of these terms is limited to what you have paid us in the twelve months before it arose.

None of that limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. If you are a consumer, your statutory rights under Spanish consumer law are unaffected by anything in this document.

Changes to these terms

We may update these terms. If a change materially affects you we will tell you by email before it takes effect. Continuing to use FICO after that is acceptance; if you would rather not, close your account and we'll refund any credits you have not used.

Law, and complaints

Spanish law governs these terms. If you are a consumer you can bring a claim in the courts where you live; otherwise the courts of Las Palmas de Gran Canaria have jurisdiction.

We keep official complaint forms (hojas de reclamaciones) at FICO, available on request. You can also complain through the consumer authorities of the Canary Islands. We would much rather you told us first — info@ficoworking.com, and we'll try to fix it.

Model withdrawal form

You only need this if you want it — an email saying you are withdrawing does the same job. Copy the text, fill in the gaps, and send it to info@ficoworking.com.
